Welcome! We appreciate your interest in Frontlands, Inc. and its affiliates (“Frontlands” “we,” or “us”). These General Terms of Service (the “General Terms”) outline the rules governing your access to and use of the website www.frontlands.com and any related websites or mobile applications (the “Site”). This includes all content, features, products, and services offered on or through the Site, including any “Loan Services” defined in Appendix B (collectively, the “Service”).
These General Terms, along with any additional agreements referenced here (listed in Appendix A) and any “Additional Terms” you agree to when using Loan Services (collectively, the “Terms”), create a legally binding agreement between Frontlands and you regarding your use of the Service. The terms “you” and “your” refer to anyone who accesses or uses the Site or Service. You may enter into these Terms on your own behalf for personal use, in which case you are a “User,” or on behalf of your employer. If you are doing so for your employer, then your employer will be considered a “Company,” and any references to “you” or “your” will apply to your employer.
ARBITRATION NOTICE
Except for certain disputes mentioned in Section 9, you agree that any disputes arising under these Terms will be settled through binding, individual arbitration. BY ACCEPTING THESE TERMS, YOU AND FRONTLANDS EACH WAIVE THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING. You give up your right to take legal action in court regarding your rights under this agreement (except for matters that can be taken to small claims court). Your rights will be decided by a NEUTRAL ARBITRATOR rather than a judge or jury. For further details, see Section 9.
MODIFICATION NOTICE
We may modify these Terms at any time by posting updated terms on the Site or sending you a copy. Revised Terms will take effect when posted but will not apply retroactively. Your continued use of the Service after new Terms are posted indicates your acceptance of those Terms. If you do not agree with any changes, your only remedy is to stop using the Service and close any accounts.
BY CLICKING ANY BUTTON THAT INDICATES ACCEPTANCE (E.G., AN “I ACCEPT” BUTTON) OR BY INSTALLING, DOWNLOADING, ACCESSING, OR USING THE SERVICE, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS, YOU ARE OVER 18 YEARS OLD (OR OLDER IF YOUR STATE HAS A HIGHER AGE OF MAJORITY), AND YOU ARE EITHER AGREEING TO BE LEGALLY BOUND BY THESE TERMS ON YOUR OWN BEHALF AS A USER OR ON BEHALF OF A COMPANY AS AN AUTHORIZED REPRESENTATIVE. IF YOU ARE ACTING ON BEHALF OF A COMPANY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND THE COMPANY TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS OR CANNOT MAKE THESE REPRESENTATIONS, YOU DO NOT HAVE PERMISSION TO USE THE SERVICE. YOUR USE OF THE SERVICE, AND FRONTLANDS’S PROVISION OF THE SERVICE TO YOU, MEANS THAT FRONTLANDS AND THE USER OR COMPANY, AS APPLICABLE, AGREE TO BE BOUND BY THESE TERMS.
1. USE OF THE SERVICE
(a) Account
To access most features of the Service, you must create an account (“Account”). When applying for your Account, you may need to provide information such as your email address, home address, a valid government-issued photo ID, and other contact details. You agree that: (a) the information you provide is accurate and will be kept updated; (b) you are solely responsible for maintaining the confidentiality of your Account and restricting access; and (c) you accept responsibility for all activities that occur in your Account or under your access credentials. You may also need to create a password. Frontlands is not responsible for any unauthorized access to your Account due to theft or misappropriation. You must notify us immediately at service@frontlands.com of any unauthorized use or suspected breach of security. We are not liable for any loss or damage resulting from your failure to comply with this section.
(b) Consent to Access, Processing, and Storage of Your Personal Data
During the registration for your Account or any Loan Services (defined in Appendix B), you agree to provide information we request for identity verification, service provision, and the detection of financial crimes. This information may include personal details such as your name, address, contact information, and banking information, including government identification and potentially biometric data. You consent to our access, processing, and retention of this personal information for service provision. This consent does not affect any rights or obligations under data protection laws. You can withdraw your consent at any time by closing your Account, though we may retain your information as required by law. You confirm that the information you provide is accurate and agree to keep it updated. You authorize us to make inquiries to verify your identity or to protect against fraud, which may involve disclosing your information to credit reference and fraud prevention agencies without affecting your credit rating. We reserve the right to monitor and disclose any information as necessary to comply with legal requirements. You also authorize your wireless provider to share your phone number and related details with us for identity verification.
(c) Payments and Authorization
Certain Service features may require payment. You will have the chance to review and accept the fees before payment. All fees are in U.S. Dollars and non-refundable. Frontlands reserves the right to set prices for the Service and will strive to keep pricing information current. We encourage you to check our website regularly for updates. Frontlands may change fees with prior notice. You authorize Frontlands to charge your payment method for any activities related to your Account, including all applicable taxes. If you use a credit card, we may pre-authorize it to ensure its validity. If payment is overdue, access to the Service may be suspended or terminated, and additional fees may apply for collection.
(d) Third-Party Services and Software
Frontlands may offer tools that allow you to share information with third-party services. By using these tools, you agree that we may transfer your information to those services. Frontlands is not responsible for third-party services’ use of your information. The Service may contain links to third-party websites, which are also outside our control. The Service may incorporate third-party software that is available under licenses that allow for broad use. You are free to obtain and use those components under their respective licenses.
2. LICENSES AND OWNERSHIP
(a) Licenses to Service
Subject to your compliance with these Terms, Frontlands grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal or internal business purposes. You may not: (i) reproduce, distribute, or publicly display the Service; (ii) modify the Service; or (iii) interfere with its features. Except for the limited license granted, Frontlands retains all rights, including intellectual property rights, to the Services, which are considered trade secrets. Unauthorized use or disclosure of Service-related information could cause Frontlands significant harm. The license does not transfer ownership of the Services to you. ALL RIGHTS NOT EXPRESSLY GRANTED ARE RESERVED BY FRONTLANDS.
(b) User Content
Certain features may allow users to upload content (“User Content”). You retain copyright and proprietary rights to your User Content. By providing User Content, you grant Frontlands a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content as necessary to provide the Services. You represent that your User Content is accurate and does not infringe any third-party rights or violate any laws.
(c) Retention
You acknowledge that Frontlands may access, preserve, and disclose content you provide if required by law or in good faith belief that it is necessary to comply with legal processes, enforce these Terms, protect rights, or address your requests.
(d) Feedback
If you provide feedback on the Service, you grant Frontlands a perpetual, irrevocable license to use that feedback in any products or services without restriction.
(e) Frontlands Intellectual Property
The Service and its materials are owned by Frontlands and protected by intellectual property laws. All materials are the property of Frontlands or its licensors. You may not use the materials without Frontlands's permission. All trademarks and related rights are owned by Frontlands or its licensors, and you may not use them without prior written consent.
3. COMMUNICATIONS
(a) Overview.
To create your Account, you must accept our Electronic Communications Policy. By doing so, you consent to being contacted by us or our affiliates at any phone number, email address, mailing address, or other contact details you provide. You agree that we, our affiliates, agents, or service providers can contact you via email, SMS (including text messages), pre-recorded calls, or automatic dialing systems at any number you’ve provided, including mobile numbers, and at any address in our records. We may also reach out to others for your contact information. Automated messages may be played when your phone is answered. If one of our agents calls you, they may leave messages on your voicemail or send texts. You can withdraw your consent at any time by contacting us at service@frontlands.com. You confirm that the phone numbers you’ve given us are yours and that you’re authorized to receive calls at those numbers. Please notify us promptly if you stop using a particular number. You’re responsible for any charges from your communication provider, and you agree that we and our agents may contact you on recorded lines, with the understanding that incoming calls may also be recorded.
(b) SMS Terms of Service.
Frontlands may send SMS messages regarding the Service, your application status, other products, and promotions. You understand that you’re not required to consent to marketing SMS messages to use the Service. YOU CAN OPT OUT OF THE SMS SERVICE AT ANY TIME BY TEXTING “STOP” TO THE NUMBER FROM WHICH YOU RECEIVED THE MESSAGE. After you text “STOP,” we’ll confirm your unsubscription. To rejoin, simply sign up again as you did initially. For assistance with the messaging program, you can reply with “HELP” or contact us at service@frontlands.com or call (888) 789-6562. (c) Push Notifications.
You agree to receive alerts about your Account activity, balances, payments, suspicious activities, and other relevant updates via push notifications to your Device. Push notifications may be delayed or affected by factors outside our control. Frontlands isn’t liable for any issues related to push notifications, including non-delivery or inaccuracies. Push notifications might not be encrypted and could include your name and Account information. Frontlands can terminate your use of push notifications at any time without notice. You can stop receiving them by changing your preferences on your Device.
Frontlands may offer an interactive chat service (“Chat”) to enhance your experience. This may involve interactions with bots or AI tools (“Chatbots”) to assist with inquiries and provide information. While we strive for accuracy, complex issues may require human assistance.
(d) Email.
We may send you emails about the Service, our products, and those of third parties. You can opt out of promotional emails by following the unsubscribe instructions in the emails.
(e) Digital Services and Communications.
The Chat service is for your convenience and may not always be available or free from errors. Chats are monitored and retained, and any personal information shared will be subject to our Privacy Policies. Using the Chat service does not imply consent for electronic records or signatures in lieu of written documents.
Users under 13 are not allowed to use the Chat service and must leave the site if prompted. You agree not to use the Chat service to send abusive, defamatory, or inappropriate messages, which could result in session termination.
We are committed to transparency and will disclose the use of Chatbots as required by law. By using the Chat service, you acknowledge these terms and our commitment to privacy and security.
Please do not share sensitive personal information, such as Social Security numbers or financial account details, through the Chat service.
4. YOUR OBLIGATIONS
(a) Compliance with Laws.
You agree to use the Service only for lawful purposes. You may not export or re-export the Service except as permitted by U.S. law. Frontlands does not guarantee that the Service is appropriate or available in your location. It’s your responsibility to comply with all applicable laws. The Service is subject to U.S. export controls and may not be downloaded or exported to certain countries or individuals on U.S. Prohibited Party Lists. By using the Service, you confirm that you are not located in or associated with any restricted country or entity.
(b) Prohibited Conduct.
BY USING THE SERVICE, YOU AGREE NOT TO: (i) engage in illegal activities or violate any laws; (ii) submit materials that infringe on third-party rights or contain unlawful content; (iii) attempt unauthorized access to the Service or download Materials using any means not provided by Frontlands; (iv) interfere with the security features of the Service; (v) disrupt the operation of the Service through harmful code or actions; (vi) commit fraud, including impersonation; (vii) sell or transfer your access to the Service; or (viii) assist others in engaging in any of these prohibited activities.
5. MODIFICATIONS
(a) Modification of Terms.
We may change these Terms at any time. Please review them periodically for updates. We may notify you of changes by posting them on the Site, emailing you, or through your Account. Changes will be effective immediately, though material revisions for existing users will generally take effect 30 days after posting. If a change significantly alters your rights, you may need to accept the modified Terms to continue using the Service. If you don’t agree, you should terminate your Account.
(b) Modification of Service.
Frontlands reserves the right to modify or discontinue the Service, including specific features, at any time without notice. We aren’t liable for any changes to the Service or for suspending or terminating your access. Frontlands may also implement software updates, which you agree to install to continue using the Service.
6. TERM AND TERMINATION
These Terms take effect when you accept them or use the Service and will remain in effect until terminated. If you violate these Terms, your access will automatically end. Additionally, Frontlands can terminate these Terms or your Account at any time, with or without notice. You can also terminate your Account by contacting service@frontlands.com. Upon termination: (a) your license will end, and you must stop using the Service; (b) you’ll lose access to your Account; (c) you must pay any outstanding amounts; and (d) Sections 2 and 7 through 10 will remain in effect.
7. INDEMNIFICATION
To the fullest extent allowed by law, you are responsible for your use of the Service and agree to defend, indemnify, and hold harmless Frontlands and its affiliates from any claims brought by third parties, including any related liabilities, damages, or expenses, arising from: (a) your unauthorized use or misuse of the Service; (b) your violation of these Terms or any applicable laws; (c) your infringement of any third-party rights; or (d) any disputes between you and third parties. We reserve the right to assume exclusive defense of any matter subject to your indemnification, and you agree to cooperate with our defense efforts.
8. DISCLAIMERS AND LIMITATIONS ON LIABILITY
(a)Disclaimers; No Warranties
Your possession, transfer, and use of any part of the Service (including your Account) is entirely at your own risk. The Service and your Account are provided on an "as is" basis. To the fullest extent permitted by law, Frontlands and all its entities disclaim all warranties, express or implied, including: (i) warranties regarding the quality, accuracy, title, non-interference, non-infringement, and fitness for a particular purpose related to the Service and your Account; and (ii) warranties that the Service and your Account, along with any data processed through them, are secure, accurate, and free from bugs, viruses, interruptions, errors, theft, or destruction. If any of these exclusions do not apply to you or are deemed void under applicable law, any warranty that cannot be excluded is limited to the shorter of: (a) 90 days from the initial delivery of the Service; or (b) the minimum period allowed by law.
None of Frontlands or its affiliates, subsidiaries, providers, or their respective personnel guarantee the accuracy, adequacy, timeliness, reliability, completeness, suitability, availability, or usefulness of any services for any purpose, and they disclaim liability for any errors or omissions. The services do not constitute an offer to sell or solicit an offer to buy or sell any security or participate in any trading strategy. They should not be relied upon for any investment decisions, and you should consult your own legal, business, or tax advisors for independent assessments of any actions. The services may be temporarily unavailable for maintenance or other reasons. Frontlands is not responsible for any errors, interruptions, deletions, defects, delays in operation or transmission, theft, destruction, or unauthorized access to user communications. Frontlands is also not liable for any technical malfunctions of any telecommunications network, online systems, servers, or services due to technical issues or internet congestion.
(b) Limitation of Liability
To the fullest extent permitted by law: (A) Frontlands's total liability for damages under these Terms will not exceed US$100 for individual users and will not exceed the greater of $100 or the total fees paid to Frontlands by a company in the last 12 months; and (B) Frontlands is not liable for any consequential, special, indirect, incidental, or punitive damages, even if informed of the possibility of such damages, or for damages relating to telecommunications failures, internet issues, data corruption, security breaches, data loss or theft, viruses, spyware, loss of business, revenue, or profits. These limitations apply regardless of any limited remedy's essential purpose.
9. DISPUTE RESOLUTION; AGREEMENT TO ARBITRATE
(a) General
To efficiently resolve disputes between you and Frontlands, except as noted in Sections 9(b) and 9(d), both parties agree that all disputes arising from these Terms will be settled through binding arbitration. This arbitration process is less formal than a court trial, utilizing a neutral arbitrator rather than a judge or jury, and allows for limited discovery and court review. Arbitrators can award similar damages and relief as courts. This arbitration agreement covers all claims related to these Terms, whether based on contract, tort, statute, fraud, or any other legal theory, even if arising after the termination of these Terms. By agreeing to these Terms, both you and Frontlands waive the right to a jury trial or to participate in a class action.
(b) Exceptions
Despite Section 9(a), neither party waives the right to: (i) bring an individual action in small claims court; (ii) pursue an enforcement action through applicable federal, state, or local agencies; (iii) seek injunctive relief in a court of law to aid arbitration; or (iv) file suit in a court regarding intellectual property infringement.
(c) Opt-Out
If you are a User and do not wish to arbitrate disputes, you can opt out of this section within 30 days of agreeing to these Terms by sending a letter to Frontlands, Inc., 3309 Elm Street, Suite 110, Dallas TX 75226. Include your full legal name, the email associated with your Account, and a statement that you wish to opt out. Once received, this section will be void, and disputes will be resolved as outlined in Section 10(b). The rest of the Terms will remain unchanged. Only Users, not Companies, can exercise this opt-out right.
(d) Arbitrator
Any arbitration will follow the Federal Arbitration Act and be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by these Terms. AAA Rules and filing forms can be found at www.adr.org or by contacting Frontlands. The arbitrator has exclusive authority to resolve any dispute regarding the interpretation or enforceability of this arbitration agreement.
(e) Notice of Arbitration; Process
A party wishing to arbitrate must first send a written notice of the dispute to the other party via certified U.S. Mail, Federal Express, or electronic mail if no physical address is available (“Notice of Arbitration”). Frontlands's address for this notice is: Frontlands, Inc., 3309 Elm Street, Suite 110, Dallas TX 75226. The Notice must describe the nature of the dispute and the specific relief sought. Both parties will try to resolve the claim directly for 30 days after the Notice is received. If not resolved, either party can start arbitration. All arbitration proceedings will be confidential unless otherwise agreed in writing. During arbitration, any settlement offers cannot be disclosed to the arbitrator until after a final decision is made. If the arbitrator awards you more than the last written settlement offer from us before the award, we will pay you the higher of the awarded amount or US$10,000.
(f) Fees
If you are a User starting arbitration according to these Terms, Frontlands will reimburse your filing fee unless your claim exceeds US$10,000, in which case fees will be governed by AAA Rules. Arbitration hearings will be held in Travis County, Texas, but if the claim is for US$10,000 or less, you may choose to have the arbitration conducted based on submitted documents, through a non-appearance telephone hearing, or in-person as established by AAA Rules. If the arbitrator finds your claim or relief sought is frivolous, fee payments will follow AAA Rules, and you agree to reimburse Frontlands for any fees incurred.
(g) No Class Actions
You and Frontlands agree to bring claims only in individual capacities, not as part of a class or representative proceeding. The arbitrator may not consolidate claims or preside over any class proceeding unless both parties agree otherwise.
(h) Modifications
If Frontlands makes future changes to this arbitration provision (except for address changes for Notice), you can reject the change by notifying us within 30 days. In that case, your account will be terminated, and the prior arbitration provision will remain in effect.
(i) Enforceability
If Section 9(g) is found unenforceable or if the entire Section 9 is deemed unenforceable, or if Frontlands receives an Opt-Out Notice from you, then Section 9 will be void, and jurisdiction and venue described in Section 10(b) will apply for any related action.
10. MISCELLANEOUS
(a)General Terms
These Terms, along with any incorporated agreements, represent the complete understanding between you and Frontlands regarding your use of the Service. You cannot assign these Terms without our prior written consent. We may assign them at any time without notice. Failure to enforce any provision does not affect our right to enforce it later, nor does a waiver of a breach mean a waiver of subsequent breaches. Section headers are for convenience only and do not affect interpretation. "Including" means "including but not limited to." If any part of these Terms is found invalid or unenforceable, the remaining parts will still be effective.
(b) Governing Law
These Terms are governed by Texas law, without regard to conflict of law principles. Both you and Frontlands submit to the exclusive jurisdiction of the state and federal courts in Travis County for any lawsuits permitted under these Terms.
(c) Notice to California Residents
If you are a California resident, under California Civil Code Section 1789.3, questions about pricing, complaints, or inquiries should be sent to Frontlands, Inc., 3309 Elm Street, Suite 110, Dallas TX 75226. You may also contact the California Department of Consumer Affairs for assistance.

The Services may allow access to sensitive information about Frontlands and its clients, which is confidential and subject to existing confidentiality obligations. You cannot disclose any confidential information to third parties in violation of these obligations. You will notify Frontlands if you suspect unauthorized access to the Services.
(e) No Support
We are not obligated to provide support for the Service. If support is offered, it will be subject to published policies.
(f) International Use
The Service is intended for users within the United States. We make no claims about the Service's appropriateness or availability outside the U.S. Access from countries where it is illegal is prohibited. If you access the Service from outside the U.S., you consent to U.S. law governing your use.
Appendix A: Incorporated Agreements
Alongside the General Terms mentioned earlier, the following agreements, policies, or notices (the “Incorporated Agreements”) are integrated into these Terms. Any capitalized terms used in the Incorporated Agreements but not defined here have the meanings given in the General Terms of Service. (a) Loan Services Provision

(b) Additional Terms
Your use of the Loan Services may also be governed by a lending agreement with Frontlands (the “Lending Agreement”). If this agreement explicitly overrides the Loan Services Additional Terms or the General Terms of Service, or includes conflicting terms regarding user access and use of the Loan Services, the terms of the Lending Agreement will prevail.
2. Information Accuracy
When submitting information for a Loan, you agree to provide accurate, complete, and current information. If any information you provide is untrue, inaccurate, outdated, or incomplete, Frontlands or its affiliates reserve the right to terminate your access to the Loan Services.
3. Additional Disclaimers
(a) Without limiting the disclaimers in the General Terms of Service, you acknowledge and agree that, on behalf of yourself and, if applicable, your company and its personnel (your “Employees”), Frontlands does not guarantee compliance of any third-party seller with applicable laws when providing Loan Services. You represent and warrant that you, and your Employees, will at all times: (A) comply with all applicable laws; and (B) cooperate with Frontlands by promptly providing any materials necessary for fulfilling its obligations under these terms and ensuring compliance with applicable laws.
(b) The calculators and tools provided within Loan Services offer estimates of generally available Loan terms. These terms may change at any time, and the actual Loan terms you receive may differ.
